The firm undertook the defense of its client by pleading the absence of her standing in relation to the claim, in addition to challenging the underlying instrument relied upon by the plaintiff and its capacity to transfer ownership or to be invoked against the parties in whose names the properties were registered.<\/p>\n<p>The defense demonstrated that transactions not registered with the competent authorities are not sufficient, in themselves, to remove official registrations or to create full real-property ownership, and that a claim for compensation first presupposes proof of the right alleged to have been infringed and the existence of a legal nexus between that infringement and each party sought to be held liable for compensation.<\/p>\n<p>The court ultimately dismissed the action in its entirety, given the plaintiff\u2019s failure to establish ownership and the absence of a legal basis for the compensation claims.
